Freedom of Information & Publication Scheme

Habergham Eaves Parish Council is subject to the Freedom of Information Act 2000 (FOIA). Under Section 19 of the Act, we are required to maintain a Publication Scheme and proactively publish certain classes of information.

How to Make a Freedom of Information Request

You can request any recorded information that Habergham Eaves Parish Council holds. To make a request:

Please describe the information you are seeking as clearly as possible. You do not need to mention the Freedom of Information Act or give reasons for your request. We will respond within 20 working days.

Some information may be exempt from disclosure under the Act. If we withhold any information, we will tell you why and explain your right to appeal.

Publication Scheme

Habergham Eaves Parish Council adopts the ICO’s Model Publication Scheme. We proactively publish information across the following seven classes:

Class 1 – Who We Are and What We Do

Class 2 – What We Spend and How We Spend It

  • Annual budget and precept
  • Accounts for the year (published on the Finances page)
  • Internal audit reports
  • Annual Governance and Accountability Return (AGAR)
  • Details of expenditure over £100 (published in council minutes)
  • Payment and procurement policies

Class 3 – What Our Priorities Are and How We Are Doing

  • Annual reports and strategic plans where produced
  • Performance information
  • Details of projects and community awards

Class 4 – How We Make Decisions

  • Agendas for council meetings
  • Minutes of council meetings — published on the Minutes page
  • Councillors’ register of interests — published on the Councillors page

Class 5 – Our Policies and Procedures

Class 6 – Lists and Registers

  • Register of Members’ Interests (available on the Councillors page and held at Burnley Borough Council)
  • Register of gifts and hospitality
  • Assets register (land and buildings — see annual accounts)

Class 7 – The Services We Offer

Information published on this website is provided free of charge. For information not available online, we may charge for photocopying, postage and other disbursements. We will advise you of any charges before fulfilling a request.

If You Are Unhappy With Our Response

If you believe we have not handled your FOI request correctly, you may ask for an internal review by writing to the Clerk. If you remain dissatisfied, you may complain to the Information Commissioner’s Office:
